If we were to dissect these Freedoms all the way down to its core, we would find an idea simply referred to as Due Process, which is also known as Due Process of Law. This concept can be broken down into simpler terms as “due process requires notice and an opportunity to be heard before adverse action is taken against an individual” (Gonzales, 2008). “In criminal cases examples of due process include the need for probable cause to arrest someone and that a criminal defendant is presumed innocent until proven guilty by an impartial judge or jury. Due process does not just exist in a criminal trial, any time a person's property interest may be taken, due process protections also apply” (Gonzales, 2008). Due Process is the most important concept in the Criminal Justice system in the United States. It has helped those that reside within its boundaries a chance to beat the numerous odds stacked against them.
